Terms of Service
Agreement:
This agreement covers
all our current and previously offered products and
services, including ABA Routing Number
Validation, Verification and ABA Database Service :
- Access to our on-line Verification and Validation
Terminal is limited to a
maximum of 2 IP addresses, regardless of the
number of computers and/or terminal attached to
that/those addresses.
More than 2 IP addresses logging in to one account may
be construed as "IP Sharing" and is a
violation of our terms and conditions, and is strictly
prohibited, and may result
in suspension and/or termination of your account.
- If you require
connection to more than 2 IP addresses under one
membership, a second subscription must be purchased
for every "2" IP Addresses that
require connection, or, you may contact us if you have
special needs via our contact
form.
Price Protection
Policy:
Our Price Protection
Policy is extended to the "Revolving Subscription
Option" only.
Selecting the "Revolving
Subscription Option", will protect your monthly
subscription fee from ever increasing at such time [if any]
that we find it
necessary to increase our prices.
In such an event, you
will continue to receive updates at the original price.
This Price Protection will
remain in effect as long as your account is active at the Revolving
Subscription option, including Standard and Commercial
License levels.
This Price Protection is
ONLY valid for REVOLVING SUBSCRIPTION OPTIONS. Those who
choose to pay term subscriptions [ eg. 2, 6 or 12 months ]
are only protected up to their expiry date, thus, renewals
will be charged at the current price.
The License Agreement
This agreement explains when and how you may use the ABA Routing Database, published
and maintained by Cramer Specialty Sales Inc.
In this agreement:
"DATABASE" means the Cramer Specialty Sales Inc. product you have purchased and the
associated documentation and other materials;
"Registered Copy" means a copy of the DATABASE purchased from us or from an
authorized Agent or Dealer, and which is not described as a trial, shareware, or
unregistered copy in the Program's sign-onmessages;
"we" or "us" means Cramer Specialty SalesInc.; "you" or "yourself" means the end user
of the Program, whether they be Individual,
Business, Company, Government Agency, BankCredit Union, or any other Organization.
"general public" means anyone not directly employed by yourself or a business you representincluding friends, relatives, family or other
associates.
"in house" means you, yourself, purchasing Company, Business or other Organization and
authorized employees.
This is a legal agreement which allows you, the end user, to use this DATABASE under
certain terms and conditions. If you
cannot agree to abide by what this agreement says you should not use this
DATABASE.
The DATABASE is fully protected by International Copyright Law.
Your use of this DATABASE is subject to the following restrictions:
1. You agree you will NOT use the information contained in this DATABASE for illegal or
fraudulent purposes.
2. You agree you will use the information contained in this DATABASE in accordance with
the license level purchased.
3. If you have more than one company, business or organization that utilizes this DATABASE, in
whole or in part, you must purchase a separate license for each.
4. You May Not I.P. Share - Access to our Virtual Terminals or Database Download
page(s) is/are limited to 2 I.P. addresses. More than 2 I.P. addresses will be flagged by the system
and may result in suspension or termination of your account as it may be
construed as I.P. sharing which
is prohibited.
STANDARD LICENSE AGREEMENT:
Under the Standard license agreement, you may use this DATABASE and the information contained for
research purposes only, and only by those within your Business, Company or Organization that are
authorized to do so, without limitation to the
number of computers or terminals networked or otherwise.
You may not resell this DATABASE in whole or in part to anyone at anytime.
You may not make this DATABASE in whole or in part, available to the general public at anytime
for free or for a fee.
You may not install this DATABASE in whole or in part into any software or other electronic or printed
medium for public distribution.
In accordance of the aforementioned, you may install this DATABASE on one or more computers, either individual
systems or networked for research purposes "in house".
You may also install this database on a server for accessibility to satellite terminals within the
purchased license level.
COMMERCIAL LICENSE AGREEMENT:
We have discontinued accepting the re-selling of our database by third parties, with the
exception of those pre-existing and currently active accounts, whereby the following restrictions
apply.
Under the COMMERCIAL LICENSE AGREEMENT, you may use this DATABASE and the information contained
for monetary gain.
You may re-sell this DATABASE to the general public for a fee, providing it is in accordance
with the U.S. Homeland Security Act, and other such sanctions and anti-terrorist legislation as
instituted by your country, by any legal means you wish.
You may provide this DATABASE to the general public for FREE providing it is in accordance
with the U.S. Homeland Security Act, and other such sanctions and anti-terrorist legislation as
instituted by your country by any means legal means you
wish.
You may alter or modify this database in whole or in part to satisfy
your needs, providing it is in accordance with the U.S. Homeland Security Act, and other
such sanctions and anti-terrorist legislation as instituted by your country, by any legal means you
wish.
You may use this database and incorporate it into any lawful
electronic medium you require, providing it is in accordance
with the U.S. Homeland Security Act, and other such sanctions and anti-terrorist legislation as
instituted by your country, by any legal means you wish.
IN GENERAL:
You may NOT use this DATABASE for fraudulent or criminal action.
No new Commercial clients will be accepted.
We cannot promise that the DATABASE will be free of bugs or program errors, but if you
report a DATABASE error or bug to us, we will do our best to correct it.
Disclaimer for Registered Copies: except as stated above, we disclaim any and all
warranties, express or implied, oral or
written, including any implied warranties of merchantability or fitness for a
particular purpose. By your purchase of this
DATABASE, you fully agree with this disclaimer.
Limitation of liability: in no event shall we be liable for any incidental,
consequential, or punitive damages whatsoever arising out of use of the
DATABASE or your relationship with us. Note
that some states in the U.S. and elsewhere do not allow exclusion or limitation of
liability for incidental or consequential damages, therefore the above limitation
may not apply to you.
In the event of errors in the DATABASE, the sole responsibility of the developer will be
to correct such errors in a succeeding edition
or update of the DATABASE. Cramer Specialty Sales Inc., it's dealers and re-sellers disclaims
all liability for loss or incidental or consequential damages arising from the use of the information
contained within this software and/or it's database.
The database is copyright, and is for the sole use of the individual or company licensed to use the
information contained within it, in accordance with the license level purchased.
Any infringement of this copyright will cause this license agreement
to become null and void, and all rights to use this software and associated database will be revoked.
By installing and/or use of this DATABASE, you are indicating your understanding and acceptance of this
license agreement in it's entirety.

REFUND POLICY
We will provide you with a full 30 days guarantee of satisfaction to evaluate whether or not this data
is suitable for your needs.
If within that 30 days of your
initial purchase, you find this information not satisfactory to your needs, you may cancel your subscription to that product
and request a full refund via our Support Ticket
system.
CANCELING SUBSCRIPTION AFTER INITIAL 30 DAYS
If you have a revolving
subscription, and you decide to cancel after the "Initial" 30 day guarantee
period has expired, you must go to your PayPal account and cancel
it yourself,
or, just notify us via our support
system, that you wish to cancel your subscription, which we will
then do "promptly" from our end. However, your subscription will continue to be active up to the date of expiry, and will not be
renewed unless you request a refund.
If you wish it cancelled
immediately, then please notify us via our Support System of
your wishes up to 5 days prior to the renewal date, and we will cancel the subscription. If you cancel with less than 5 days
remaining, no refund will be provided and your subscription
will remain active for how many days are remaining.
If you are on a Term Subscription [eg. 6 or 12 month package], and 30 days has expired, you must request an immediate cancellation and refund of the remaining time via our
support system. Your refund will be pro-rated according to
time remaining, and refunded back to your PayPal account.
If you are on a Term Subscription
[eg. 6 or 12 month package], and 30 days has NOT expired,
your account will be cancelled immediately and your initial
purchase refunded back to your paypal account.
If you have paid by Check or
Money Order, and your cancellation has been received prior
to depositing the funds, we will return the check to you
un-cashed.
If the check has been
deposited prior to receiving your refund request, but within
the 30 days, we reserve the right to with hold any refunds
up to 2 months to ensure funds have cleared plus deduct a
20% processing fee if Check is cashed.
There will be no Pro-Rated
refunds beyond the 30 day period for Check or Money Order
payments.
